INTRODUCTION

Thank you for choosing Prime Safaris & Tours Ltd.

We are committed to providing memorable, safe, and high-quality travel experiences throughout Uganda, Rwanda, Kenya, Tanzania, the Democratic Republic of Congo, and other destinations across Africa.

Please read these Booking Terms & Conditions carefully. By confirming a booking and making payment, you acknowledge that you have read, understood, and accepted these Terms & Conditions on behalf of yourself and all persons included in your booking.

If you have any questions regarding these Terms & Conditions, please contact us before confirming your reservation.

  1. BOOKINGS & RESERVATIONS

Prime Safaris & Tours Ltd acts as a tour operator and destination management company, arranging transportation, accommodation, meals, excursions, permits, park entries, flights, and other travel services through carefully selected independent suppliers.

All itineraries, descriptions, prices, and information provided by Prime Safaris & Tours are based on information available at the time of quotation and are believed to be accurate. However, we reserve the right to correct any errors, omissions, or inaccuracies that may occur.

To secure gorilla permits, chimpanzee permits, flights, and other travel arrangements, clients must provide:

  • Full names exactly as they appear in the passport
  • Nationality
  • Passport number
  • Passport expiry date (where required)

Clients must notify Prime Safaris & Tours at the time of booking of any:

  • Medical conditions
  • Physical disabilities
  • Dietary requirements
  • Allergies
  • Special needs
  • Other special requests

We will make every reasonable effort to accommodate such requests but cannot guarantee that all requests can be fulfilled.

All bookings are subject to availability and are not confirmed until written confirmation has been issued by Prime Safaris & Tours Ltd.

Many lodges, camps, and gorilla permits have limited availability and therefore early booking is highly recommended.

Prime Safaris & Tours reserves the right to charge additional administrative and supplier costs for any booking amendments requested after confirmation.

Prime Safaris & Tours enters into agreements on behalf of clients with third-party suppliers including:

  • Hotels and lodges
  • Airlines
  • National parks
  • Gorilla and chimpanzee permit authorities
  • Ground handlers
  • Transportation providers

The booking conditions of these suppliers shall also apply and may affect cancellation, amendment, refund, and operational policies.

  1. PRICES & WHAT IS INCLUDED

Unless otherwise stated, safari prices include:

  • Accommodation as specified in the itinerary
  • Meals as indicated
  • Ground transportation
  • English-speaking driver/guide
  • Park entrance fees
  • Ranger fees
  • Airport transfers where applicable
  • Activities specifically stated in the itinerary
  • Bottled drinking water while on safari

Unless specifically included, safari prices do NOT include:

  • International flights
  • Domestic flights
  • Visa fees
  • Passport fees
  • Travel insurance
  • Drinks and beverages
  • Laundry services
  • Telephone and internet charges
  • Tips and gratuities
  • Personal expenses
  • Optional activities not included in the itinerary

All prices are quoted in the applicable currency and are subject to availability.

Prime Safaris & Tours reserves the right to adjust prices before final payment in the event of:

  • Exchange rate fluctuations
  • Increases in government taxes
  • Fuel surcharges
  • Permit fee increases
  • Airline surcharges
  • Park fee increases
  • Other supplier cost increases beyond our control

Any such increases shall be communicated to the client as soon as reasonably possible.

  1. EXECUTION OF THE SAFARI

Wildlife viewing can never be guaranteed because animals live freely in their natural habitat.

Similarly, gorilla and chimpanzee permits grant permission to track these primates but do not guarantee sightings, proximity, weather conditions, or duration of viewing.

Accommodation is generally provided in twin, double, single, or family rooms depending on the booking arrangement and availability.

Where circumstances require, Prime Safaris & Tours reserves the right to substitute:

  • Lodges
  • Camps
  • Hotels
  • Vehicles
  • Activities
  • Routes
  • Guides

with comparable or superior alternatives.

The company reserves the right to modify itineraries where necessary due to:

  • Weather conditions
  • Road conditions
  • Security concerns
  • Park regulations
  • Government directives
  • Supplier operational requirements
  • Force Majeure events

Such changes shall not constitute a breach of contract.

Prime Safaris & Tours may use carefully selected subcontractors or partner companies to provide certain services.

Clients are required to follow all instructions given by guides, drivers, rangers, accommodation staff, park authorities, and government officials.

Prime Safaris & Tours reserves the right to refuse or terminate participation of any client whose behavior:

  • Endangers themselves or others
  • Violates local laws
  • Causes serious inconvenience to other travelers
  • Damages property
  • Harms wildlife or the environment

In such cases, no refund shall be payable.

  1. PAYMENT TERMS

To confirm a safari booking:

  • A minimum deposit of 30% of the total safari cost is required.
  • Gorilla permits, chimpanzee permits, flights, and any services requiring immediate payment must be paid in full at the time of booking.

The remaining balance must be paid no later than 30 days before arrival unless otherwise agreed in writing.

Bookings made within 45 days of arrival require full payment at the time of confirmation.

Prime Safaris & Tours reserves the right to cancel any reservation where payments are not received by the specified due dates.

Payments may be made by:

  • Bank transfer
  • Credit card
  • Approved electronic payment methods
  • Cash (where permitted)

Any bank charges, transfer fees, card processing fees, intermediary bank charges, or currency conversion costs shall be borne by the client.

  1. CANCELLATIONS & REFUNDS

All cancellation requests must be submitted in writing and shall become effective on the date received by Prime Safaris & Tours Ltd.

Important Notice

Before calculating any refund, the following non-refundable items shall first be deducted from the total invoice amount:

  • Gorilla permits
  • Chimpanzee permits
  • Park permits
  • Airline tickets
  • Hotel deposits
  • Government fees
  • Visa fees
  • Supplier penalties
  • Administrative charges
  • Other non-recoverable costs incurred on behalf of the client

Refunds shall only apply to the remaining recoverable amount from the total safari invoice amount.

Cancellation Charges

No refund shall be payable for:

  • Unused services
  • Voluntary withdrawal from a tour
  • Late arrival
  • No-show
  • Early departure
  • Missed activities
  • Missed flights or connections

Prime Safaris & Tours shall not be responsible for any expenses, losses, penalties, or additional costs resulting from cancellation or rescheduling by the client.

All Refunds shall be effected to the client with in a period of 30 days from the time of agreement to the actual amount between the company and the client.

  1. FORCE MAJEURE

Prime Safaris & Tours Ltd shall not be liable for any failure, delay, alteration, interruption, rescheduling, or cancellation of services resulting from Force Majeure events beyond its reasonable control.

Force Majeure includes but is not limited to:

  • War or threat of war
  • Armed conflict
  • Terrorism
  • Civil unrest
  • Riots
  • Political instability
  • Government restrictions
  • Border closures
  • Visa restrictions
  • Epidemics and Pandemics
  • Public health emergencies
  • Quarantine measures
  • Natural disasters like; –
  1. Earthquakes
  2. Floods
  3. Hurricanes
  4. Landslides
  5. Volcanic eruptions
  6. Wildfires
  7. Severe weather
  • Airline cancellations
  • Airport closures
  • Transportation disruptions
  • Fuel shortages
  • Strikes
  • Utility failures
  • Acts of God
  • Any extraordinary circumstance beyond reasonable control

Where Force Majeure affects a safari, Prime Safaris & Tours may:

  • Change accommodations
  • Modify routes
  • Adjust activities
  • Reschedule departures
  • Postpone travel
  • Cancel services where necessary

Prime Safaris & Tours shall not be liable for consequential losses including:

  • Loss of enjoyment
  • Business losses
  • Missed flights
  • Additional accommodation costs
  • Additional transportation costs
  • Personal expenses

Any refund shall be limited to amounts actually recovered from suppliers, less any unrecoverable:

  • Permit fees
  • Government charges
  • Supplier penalties
  • Administrative expenses
  • Banking charges
  • Service fees

Where applicable, gorilla permits, chimpanzee permits, park fees, concession fees, and government-issued permits remain subject to the refund policies of the issuing authorities.

Prime Safaris & Tours cannot guarantee refunds where such authorities refuse reimbursement.

No refund shall be due for unused services once travel has commenced due to Force Majeure affects.

Clients are strongly encouraged to purchase comprehensive travel insurance covering cancellation, interruption, medical emergencies, evacuation, and Force Majeure events.

  1. TRAVEL INSURANCE

Comprehensive travel insurance is mandatory for all travelers.

Insurance should cover:

  • Medical expenses
  • Emergency evacuation
  • Repatriation
  • Trip cancellation
  • Trip interruption
  • Personal liability
  • Loss of luggage
  • Force Majeure events

Clients travel entirely at their own risk where insurance is not obtained.

  1. COMPLAINTS

If a problem arises during your safari, it must be reported immediately to:

  1. Your Prime Safaris & Tours guide or representative; and
  2. The relevant service provider.

This allows an opportunity to resolve the issue during the safari.

Any unresolved complaint must be submitted in writing within 30 days after completion of the tour.

Prime Safaris & Tours cannot accept liability for complaints reported outside this period.

  1. LIABILITY

Prime Safaris & Tours shall exercise reasonable care and skill in arranging and operating safaris.

However, Prime Safaris & Tours acts as an intermediary between clients and independent suppliers and cannot accept responsibility for acts, omissions, errors, delays, cancellations, injuries, losses, or damages caused by:

  • Airlines
  • Hotels
  • Lodges
  • Transportation providers
  • Government authorities
  • National parks
  • Permit issuing authorities
  • Other third-party suppliers

Prime Safaris & Tours shall not be liable for:

  • Loss or damage to baggage
  • Loss of personal belongings
  • Injury
  • Illness
  • Death
  • Delays
  • Missed connections
  • Additional expenses arising from circumstances beyond our control

Clients are responsible for ensuring they possess:

  • Valid passports
  • Visas
  • Vaccination certificates
  • Travel permits
  • Health documentation
  • Any other entry requirements

Clients are responsible for seeking medical advice prior to travel and ensuring they are fit to participate in safari activities.

  1. GOVERNING LAW & JURISDICTION

These Terms & Conditions shall be governed by the laws of the Republic of Uganda.

Any dispute arising from these Terms & Conditions or from services provided by Prime Safaris & Tours Ltd shall be subject to the exclusive jurisdiction of the courts of Uganda but priority shall be given to mediation efforts to resolve any depute.
